Each of us handles personal information in the way described in this policy. If you are not sure which company holds your information, contact us at achieve@emplify.com.au and we will tell you.

This policy covers everyone we hold personal information about: website visitors, trial participants, members, and parents/guardians of participants under 18.

The information we collect

Depending on your relationship with us, we may collect:

·       Contact details: name, email address, mobile number, home address

·       Date of birth

·       Emergency contact details: name, relationship, email, mobile, address

·       Membership and attendance information: enrolment details, class attendance, grading and belt progression history

·       Payment information: processed by our payment providers (see Who we share information with, below). We do not store full card or bank account details ourselves

·       Health and medical information, such as medical conditions, allergies, injuries and medications, collected only where relevant to training safely

·       Photos and video taken during classes, gradings and events

·       Website and device information, such as pages visited and general location, via cookies and similar technologies

Where the information relates to a child, a parent or guardian provides and manages it on the child’s behalf, and is the account holder even though the child is the person the information is about.

How we collect it

We collect personal information when you:

·       Complete a trial or membership sign-up form (online or via our member management system, Clubworx)

·       Complete a waiver, or a health/medical questionnaire

·       Purchase a trial or membership through our website (emplify.com.au or kangakarate.com.au)

·       Attend a class, grading or event

·       Contact us directly (phone, email, in person)

·       Browse our websites, via cookies and analytics/advertising tools (see Cookies and advertising, below)

Why we collect and use it

We use your (or your child’s) personal information to:

·       Process trial and membership sign-ups and payments

·       Enrol you or your child in classes, manage attendance, and track grading and progression

·       Communicate with you about classes, bookings, gradings, events and account matters

·       Keep participants safe, including using emergency contact and health information to respond appropriately if something happens during training

·       Market our programs to you, including retargeting advertising (see Cookies and advertising)

·       Meet our legal, financial and insurance obligations

If you don’t provide the information we ask for, we may not be able to enrol you or run classes safely.

Who we share information with

We share personal information only as needed, with third party service providers. They help us with:

·       holding our member records;

·       processing direct debit membership payments and trial purchase payments;

·       website analytics and advertising, including retargeting (see Cookies and advertising);

·       emails and document management; and

·       reporting and admin support, including through AI tools. These tools may process personal information as part of that work, on our instruction.

We only give these providers the information they need to provide that service.

We also share personal information with:

·       our own instructors and dojo staff, for supervision, safety and day-to-day operations; and

·       government or regulatory bodies where we are required to by law.

We never sell your personal information.

Overseas disclosure

Several of our third party providers are based overseas or use overseas/global cloud infrastructure, so your personal information may be processed in countries including the United States.

Cookies and advertising

Our websites use cookies and similar technologies, including Google Analytics, and Meta and Google retargeting/advertising pixels, which may show you Emplify or Kanga Karate ads on other websites and platforms after you’ve visited ours. You can control cookies through your browser settings, and opt out of personalised advertising through your Google and Meta account settings.

Photos and video

We may take photos and video during classes, gradings and events, and use them for marketing, including on our website and social media. This is described in our Terms & Conditions, which you agree to when signing up. If you’d prefer not to consent to your (or your child’s) image being used this way, let us know and we will provide a version of the sign-up form without media consent. You can also withdraw consent at any time by contacting us (see Contact us, below).

How we keep your information secure

We take reasonable steps to protect personal information from misuse, loss, and unauthorised access, including restricting access to our member management system to authorised staff.

If we experience a data breach that’s likely to result in serious harm, we’ll respond in line with the Notifiable Data Breaches scheme, including notifying affected individuals and, where required, the Office of the Australian Information Commissioner (OAIC).

How long we keep information

We keep personal information only for as long as we reasonably need it, to provide our services, manage memberships, respond to a claim, and meet our legal, tax and insurance obligations.

After a membership ends we also keep basic contact details (your name, email address, mobile birth year and postcode), along with the member’s last program and dojo location, so we can let you know about programs that may suit you if you return to training with us. You can ask us to delete these at any time (see Accessing, correcting or deleting your information, below).

When we no longer need personal information, we take reasonable steps to delete or de-identify it.

Accessing, correcting or deleting your information

You can ask us for access to the personal information we hold about you or your child, ask us to correct it, or ask us to delete it, including opting out of win-back marketing at any time, by contacting us (see below). We’ll respond within a reasonable time, and let you know if we can’t make a change you’ve asked for and why (for example, where we need to keep certain records for legal or financial reasons).

Complaints

If you have a concern about how we’ve handled your personal information, contact us first (see below) and we’ll do our best to resolve it. If you’re not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

Children’s information

Most of our participants are children. Where a participant is under 18:

·       A parent or guardian provides consent and manages the account on the child’s behalf, even though the information relates to the child.

·       We collect health and emergency contact information specifically to keep the child safe during training.

·       Photo and video consent is handled as described above.

·       We retain a child’s information in line with the approach above, and delete or de-identify it once no longer needed.

·       Once a participant turns 18, they may exercise these rights themselves in relation to their own information.

·       Where a child’s parents or guardians are separated, we provide information to any parent or guardian with parental responsibility, unless we’ve been given a copy of a court order that limits this.
